Are you and your spouse not speaking or are unable to come to an agreement on some or all issues pertaining to your divorce or other family law matter? Are you concerned that your spouse was in charge of the finances throughout the marriage and you have no idea what assets you are entitled to? Is your spouse a narcissist and you believe that he or she is hiding things or intentionally engaging in actions to hurt you? If so, you need a strong, experienced attorney to represent YOUR interests, YOUR rights, and advocate for YOU to ensure you get what you are entitled to. An experienced divorce and family law attorney will advise you on how to proceed, what to expect during the process, how to best help your children through this process, best legal strategies to obtain your goals, and will stand by you every step of the way. It is important to know that if you retain my firm, we take a child-centered approach when children are involved. We work with you to ensure your children get through this process with dignity, love, a relationship with both parties, and as little stress as possible.

Are you and your spouse in agreement on all of the issues in your divorce or other family law matter? In an uncontested divorce, for example, you can end your marriage without the back and forth negotiations, court hearings, legal strategizing, or trial. You and your spouse work together toward mutually agreeable solutions, which typically preserves your relationship to be able to move forward and effectively co-parent without animosity. You and your spouse have more control over the outcome, as opposed to a stranger like a third party or judge. In addition, an uncontested divorce (or other family law matter) enables you to plan for and deal with your futures without blame and fault, as well as allows for "out of the box" thinking and creative solutions.

Divorce Mediation is a process whereby the divorcing parties work with an impartial and neutral third party, called a Mediator, in an attempt to reach an agreement on the issues pertaining to their divorce. It is an informal, non-adversarial process, and any agreement that may be reached is a voluntary agreement. It is through Divorce Mediation that the parties work towards solutions (which can be creative) that work for both of them. The decision-making rests with the parties, not a stranger (like a judge). Divorce Mediation can be very cost-effective and less stressful on the parties (and children).

Collaborative Divorce provides clients with a divorce that is private, confidential, and out-of-court. As opposed to a "court battle", where personal and financial information is in the public record for anyone to see, Collaborative Divorce allows parties to work out their divorce matters out of the public eye. Similar to mediation, the parties are in control, as opposed to a third party (like a judge) who will make decisions that impact your life but who knows nothing about your family.
How do you even start the Collaborative Divorce process? Hire an experienced divorce attorney who understands the value in the collaborative process, and who knows, from years of experience litigating divorce and family law matters, that this is a cost-effective and less stressful way to settle your issues. Along with Elissa and your spouse's collaboratively trained attorney, there will be other individuals on your Collaborative Divorce team. This likely includes (1) a forensic accountant who works with both you and your spouse in determining options for the distribution of your marital property, with an understanding of your potential tax consequences; and (2) a mental health counselor who will help ensure the process runs smoothly, advise the parents on child-related issues (such as timesharing, co-parenting, and communication), assist in promoting an emotionally and physically safe environment for the collaborative process, and work with the parents to encourage mutually respectful communication.
